In Trailfinders Ltd v Travel Counsellors Ltd [2020] EWHC 591 (IPEC) the High Court reviewed the scope of imploed terms in relation to confidentiality, set against the backdrop of the Trade Secrets (Enforcement etc) Regulations 2018. The case provides a useful and timely summary of the principles.
